IN a significant legal reforms move, the Dubai Govt
last Monday expanded the jurisdiction of Dubai International Financial
Centre (DIFC) Courts to allow companies based beyond the tax-free business
park to bring their cases to the common law court.
Businesses can now opt to take their cases to
the DIFC Courts if both parties agree to its jurisdiction. Contracts may also
include a condition binding both parties to go for the English-language court
in the event of a disagreement.
“[The decision] provides businesses with more choice; choice to have their cases
heard in Arabic or English, using civil or common law procedures,” Michael Hwang,
Chief Justice of the DIFC Courts, told Arabian Business.
