RIDING piggyback on the Gujarat HC latest decision on the
question of levy of capital gains in a transaction involving transfer of
infrastructrual assets, the Union of India has moved the Apex Court to have a
re-look at the USD 11bn landmark decision in the Voda case.
It is
learnt that the AG and ASG have pleaded before the Chief Justice Bench to get
the Voda decision post-mortemed by the Constitution Bench of Five Judges.
However, the Voda Senior Counsel, Mr Harish Salve, has predictably opposed the
AG's prayer tooth and nail.
